Hans Kelsen’s Democracy: Issues and Controversies
This essay addresses how the Austrian jurist Hans Kelsen, starting from a radical and interesting critique of the concept of the people as a political subject, equipped with its own will and as a prerequisite of the democratic system itself, develops a theory of representative and parliamentary democracy considered as a balance between heteronomy and freedom. After discussing some of the most relevant political-theoretical components of Kelsen’s Demokratielehre, the essay will problematize it by focusing on some of its controversial aspects.
