Un análisis jurídico-institucional aplicado a los programas sociales y las cuotas de género en América Latina

Institutions formelles et informelles : une analyse juridico-institutionnelle appliquée aux programmes sociaux et aux quotas de genre en Amérique latine
Cet article propose une approche juridique des analyses promues par les théories institutionnalistes, et relie ces analyses à une conception essentielle de la démocratie et à deux problèmes des démocraties latino-américaines : la sous-représentation des femmes dans les parlements et le clientélisme politique dans le cadre de la distribution des programmes sociaux. Pour ce faire, nous commençons par une approximation du concept d'institutions informelles, qui est au cœur des analyses institutionnalistes, et reconnaissons deux types d'institutions informelles aux caractéristiques différentes. Après avoir offert une conception essentielle de la démocratie, de ses conditions et de ses facteurs déterminants, on analyse comment les institutions informelles ont affecté l'efficacité et l'efficience des normes juridiques dictées pour promouvoir les quotas de genre dans les élections parlementaires et, en contrepartie, on montre comment une conception adéquate des programmes de distribution de plans sociaux a réussi à neutraliser les institutions informelles telles que le clientélisme et la petite corruption, qui ont directement affecté les démocraties latino-américaines. Enfin, quelques idées sur la pertinence d'une bonne architecture législative et son lien avec les institutions informelles sont proposées.
